Tenant Rights and Submetering in Ontario

When a rental building transitions to submetering, tenants often have questions about their rights. Ontario has specific consumer protections in place through the OEB Unit Sub-Metering Code and related legislation.

Under the Unit Sub-Metering Code (USM Code), your submetering provider must meet minimum standards for billing accuracy, customer service, and dispute resolution. These standards are set by the Ontario Energy Board (OEB) and apply to all licensed Unit Sub-Meter Providers (USMPs) in the province.

You have the right to receive a clear, itemized bill that shows your consumption, the applicable rates, delivery charges, and any service fees. Each charge must be clearly identified. Your provider cannot bundle charges in a way that makes it difficult to understand what you are paying for.

If you believe your bill is incorrect, you have the right to request a billing investigation. Your submetering provider must have a process for handling complaints and disputes. If you are not satisfied with the provider's response, you can escalate the matter to the OEB.

Your meter must meet Measurement Canada standards for accuracy. If you have concerns about your meter's accuracy, you can request a meter test. The testing process and any applicable costs are outlined in the USM Code.

Ontario's Residential Tenancies Act (RTA) applies to rental buildings. The introduction of submetering in a rental building follows specific legal requirements. We recommend tenants review the RTA provisions or consult with the Landlord and Tenant Board if they have questions about how submetering affects their tenancy.

Financial assistance programs like the Ontario Electricity Support Program (OESP) are available to eligible submetered tenants. OESP provides a monthly on-bill credit for qualifying low-income households. Your submetering provider can provide information about how to apply.

If you are moving into a submetered building, ask about the billing structure before signing your lease. Understanding how electricity is billed helps you budget appropriately and avoid surprises.
